In der Entscheidung vom 12. 5. 2011 hat der EuGH eine zentrale Einschränkung der umweltrechtlichen Verbandsklage fär unionsrechtswidrig erklärt. Weder in der Zulässigkeit noch in der Begründetheit eines Umweltrechtsbehelfs darf die Prüfung auf Normen beschränkt werden, die Rechte Einzelner begründen. Damit ist die Debatte über den Umfang des Rechtsschutzes im Umweltrecht wieder eröffnet.
