This article is based on the assumption that the current European debate on how one can solve issues related to the transfer of property in corporeal movable assets in an optimal manner may be further enhanced in terms of transparency, structure, and completeness. It is suggested that the discourse of property law may profit from applying tools developed in the discipline of argumentation analysis. Part 1 of the article seeks to identify problems inherent in the current debate and presents a general outline of a methodological approach, integrating techniques derived from the field of argumentation theory, at different levels of analysis. Part 2, to be published in the next issue of the European Property Law Journal, will try to exemplify the benefits of this approach by discussing a number of instances taken from both national and international debates.
