Автор обращается к ретроспективе развития концепции неделимой вещи в отечественном праве советского периода. Указывается на то, что если ее существование до революции 1917 г. предопределялось позитивным правом, то после данного исторического события правовое регулирование объектов, подпадающих под правовой режим неделимой вещи, было довольно фрагментарным. Однако автором акцентируется внимание на том, что, несмотря на отсутствие в нормативных актах СССР легальной дефиниции понятия «неделимая вещь», законодатель обращался к нему в отдельных институтах, например солидарных обязательствах или общей собственности. Кроме того, критерии неделимости вещи становились предметом ряда цивилистических исследований. Например, особое внимание правоведов уделялось вопросу о возможности раздела жилой недвижимости. Указанные критерии неделимости использовались также правоприменительной практикой, что подтверждается в частности судебными актами Верховного суда СССР. Делается вывод, что законодательство и доктрина советского периода во многом продолжили традиции дореволюционной цивилистики и послужили базой для формирования правового режима неделимой вещи в гражданском праве Российской Федерации. In this article the author refers to the retrospect of the concept of indivisible things in the domestic law of the Soviet period. It is indicated that before the revolution of 1917 its existence of this concept was determined by positive law while after it the legal regulation of the of objects, subject to the legal regime of the indivisible things, was quite fragmented. However, the author focuses on the fact that, despite the lack in the legislation of the legal definition of the “indivisible thing”, the legislator referred to this term in certain institutions, such as solidary obligations or common ownership. In addition, the criteria of indivisibility were the subject of a number of civil research works. For example, particular attention was given to the issue about the splitting up of the possibility of residential real estate. The criteria of things indivisibility also were used in the law enforcement practice which is evidenced by judicial acts of the Supreme Court of the USSR. The author concludes that legislation and doctrine of the Soviet period largely continued the traditions of pre-revolutionary civil law and served as a base for the formation of the legal regime of the indivisible things in civil law of Russian Federation.
