In this paper we propose a reflection of the meanings from which the functional diversity qualifies as object and problem of intervention of the social services. We centre on the category of dependence while the Law 39/2006, on the Promotion of Personal Autonomy and Care for Dependent Persons (LAAD) composes most of the public action of the social services for the persons with functional diversity. As conclusions we can extract that the (LAAD) relates disability and dependence to a disfunctional condition of the person who associates with certain lacks or anomalies in the health conditions. This way the LAAD tends to be focused on the bio-physical factors without considering too much the contexts and the restrictions that generate the situations of dependence.
