The economic benefit awarded for the expense of a personal caregiver (regulated in Art. 19 of Law 39/2006, of 14 December, for the Promotion of Personal Autonomy and Care for dependent persons) presupposes the existence of an employment relationship, direct or indirect, linking the person in a situation of dependence to the personal caregiver. This paper discusses the legal framework of this relationship, beginning with the delimitation of the concept of personal caregiver in contrast to similar figures for which the Law also provides, which naturally have a different legal situation (home care services, care in family settings). It also explores the specific meaning of the activities corresponding to the personal caregiver according to the ideas of the Independent Living Movement, in which this figure arose for the first time.
