Aims of the present article demonstrate, so clear and concise, the changes resulting from the Law n° 13.105 /15 in terms of the appeal of Grievance, more specifically in relation to the decisions of the judges in the first grade. For both, contrasts the immanent guidelines the current diploma, as well as the texts of the Federal Senate and Chamber of Deputies. Even from the perspective of the new Code of Civil Procedure, it is a critical analysis of systematic coherence between the text promulgated and the constitutional right of defense, in addition to building weights about possible problems arising from the new scheme recursal.
