DOI: 10.12957/dep.2017.23508 Resumo No artigo “O apartheid do direito: reflexoes sobre o positivismo juridico na periferia do capital”, tematizo como a ideologia positivista foi adaptada no Brasil e se expressa por meio de alguns elementos que sao constitutivos da forma juridica tal qual se desenvolveu nos paises perifericos do capitalismo. Parte das discussoes travadas na tese de doutorado “Um estalo nas faculdades de direito: perspectivas ideologicas da Assessoria Juridica Universitaria Popular” (2015), o presente artigo apresenta alguns elementos da pesquisa de campo realizada para o trabalho doutoral, baseando-se no materialismo historico-dialetico. O marco teorico transita no campo da tradicao marxista, em especial as analises de G. Luckacs, E. Pachukanis, I. Meszaros e Florestan Fernandes; dialogando tambem com as analises de Roberto Schwartz e Sergio Buarque de Holanda, alem de algumas formulacoes de teoricos criticos no campo juridico. Palavras-chave: direito e marxismo; positivismo juridico; ideologia. Abstract The article "The apartheid of Law: reflections on legal positivism at the periphery of capital" approaches how the positivist ideology adapted to Brazil and how it is expressed through elements that constitutes the legal form as it has developed in peripheral capitalist countries. Being a part of the discussions held in the doctoral thesis "A snap in law schools: ideological perspectives of university students’ popular legal counsels" (2015), this article presents some elements of the field research that was executed for the doctoral work, based on historical and dialectical materialism. The theoretical framework transits in the field of Marxist tradition, especially the analysis of G. Luckacs, E. Pachukanis, I. Meszaros and Florestan Fernandes; also dialoguing with the analysis of Roberto Schwartz and Sergio Buarque de Holanda, as well as some formulations by critical theorists in the legal field .
