Since an important part of the world population lacks the water and sanitation service, efforts are being carried out to establish the access to water and sanitation as a Human Right. is work addresses such discussion and, therefore, aims to answer the following questions: Which is the origin, content and scope of the Human Right to water and sanitation?; and What are the challenges posed in the practice, the application by the States, and the resulting Right to be exercised by the citizens? It is concluded that there are strong limitations and uncertainties when putting into practice the international guidelines by the States, so that they can comply with this obligation –as it implies substantial changes in the public policies, nancing strategies, institutional and legal logic– as well as when it comes to cope explicitly with the issue of the social inequalities.
