This study tackles the doctrinal penalties in the Islamic penal legislation in relation to human rights in the contemporary legal systems.
The research explained the meaning of “doctrinal penalties” in the traditions of the Muslim jurists and the standpoint of the Sudanese Penal Code on the issue, then it tackled and explained each of the “doctrinal penalties” in relation to human rights with the conclusion that these penalties involve an immense consideration of human rights.
The implementation of these “doctrinal penalties” sustains the human soul, mind, honor, religion and property.
“Doctrinal penalties” are not made for vengeance or retaliation; they are prescribed out of infinite wisdom and knowledge of the human soul which could not be deterred from its evil desires and lusts save by the force of these “doctrinal penalties”.
Hence, all claims that “doctrinal penalties” violate human rights are nothing but entirely biased, unrealistic and untrue allegations which should be refuted and exposed as well as those who adopt them
