Despite the many differences that exist between different countries when it comes to employment in the public sphere, the executive (administrative) sphere, which is the area of ​​functioning of the office apparatus, is separated, as a rule, from the sphere of political employment of persons holding senior management positions in the state or being members of representative bodies. Such persons have a special legal status. If we assume that they remain in a relationship of employment, then this is a different legal relationship than labor or service. In Poland, the name "constitutional-legal employment relationship" is accepted for them.
