Despite the many differences that exist between different countries when it comes to employment in the public sphere, the executive (administrative) sphere, which is the area of functioning of the office apparatus, is separated, as a rule, from the sphere of political employment of persons holding senior management positions in the state or being members of representative bodies. Such persons have a special legal status. If we assume that they remain in a relationship of employment, then this is a different legal relationship than labor or service. In Poland, the name "constitutional-legal employment relationship" is accepted for them.
