The article deals with the appointment of punishment in case of recurrence of crimes. The question of taking into account the relapse as an aggravating circumstance in the appointment of punishment has been investigated. The author considered the issue of the importance of dividing recidivism into types, and also suggested ways to increase the effectiveness of the fight against recidivism and in order to ensure the principle of justice.
