PERLINDUNGAN HUKUM PENGGUNA E-WALLET DANA DITINJAU DARI UNDANG-UNDANG PERLINDUNGAN KONSUMEN

Penulisan artikel ini bertujuan untuk mengetahui sistem perlindungan hukum dan pertanggungjawaban yang diperoleh pengguna dompet elektronik Dana apabila terjadi kerugian yang disebabkan oleh masalah pada sistem pelayanan fitur-fitur yang diberikan pada aplikasi tersebut. Penulisan artikel ini menggunakan metode penelitian hukum normatif melalui pendekatan undang-undang. Hasil studi menunjukan bahwa pengguna dapat melakukan penuntutan atas kerugian yang mereka alami sebagai wujud pemenuhan atas hak-haknya sebagai pengguna dompet elektronik serta pihak dompet elektronik (e-wallet) Dana bertanggung jawab atas kesalahan yang mengakibatkan kerugian terhadap pengguna aplikasi tersebut yaitu pihak dompet elektronik (e-wallet) bertanggung jawab atas pemberian ganti rugi dan pemberian informasi yang jelas, informasi tersebut berupa informasi mengenai term & condition yang memaparkan secara jelas bagaimana tanggung jawab kedua belah pihak baik konsumen dan penyedia aplikasi, dan tanggung jawab ganti rugi yang diakibatkan oleh kerusakan sistem dompet elektronik (e-wallet) Dana. This article has a purpose that is to anlyze the system of the legal protection and obligations obtained by Dana consumers by Dana e-wallet if there are losses caused by problems with the service system features provided in the application. The writing of this article uses a normative research through statute approach. The results of the study show that the users can sue for their losses as a form of fulfilling their rights as a user of e-wallet and e-wallet Dana must provide accountability in the form of compensation for losses suffered by the users and e-wallet Dana must be responsible for errors that result in losses to users of the application, so e-wallet Dana parties must be responsible by giving compensation and giving clear information, this information is in the form of information about terms & conditions which clearly describes the responsibilities of both parties, both consumers and application providers, and compensation for damages caused by damage to the electronic wallet system (e -wallet) Dana.
