ABSTRAKPenelitian ini mengkaji permasalahan daluwarsa penuntutan pada studi kasus Putusan Mahkamah Agung Nomor 360 K/MIL//2017 yang bertujuan untuk mengetahui kesesuaian penerapan pengaturan dalam Kitab Undang-Undang Hukum Pidana, Kitab Undang-Undang Hukum Pidana Militer dan Undang-Undang Nomor 31 Tahun 1997 tentang Peradilan Militer terhadap fakta hukum yang terdapat dalam Putusan Mahkamah Agung Nomor 360 K/MIL//2017. Kesimpulan dari hasil penelitian ini adalah putusan Judex Facti dalam delik aduan turut serta melakukan perzinahan yang telah kadaluwarsa tidak sesuai dengan Pasal 74 Ayat (1) KUHP. Judex Facti telah salah dalam menerapkan hukum atau tidak berdasar pada hukum sebagaimana mestinya dan mengabaikan fakta bahwa sesungguhnya penuntutan tersebut sudah kedaluwarsa melebihi jangka waktu 6 (enam) bulan. Kata Kunci: Kedaluwarsa, Perzinahan  ABSTRACTThis study examines the problem about criminal complaint which has exceeded the statute of limitation on case study of Supreme Court Decision Number 360/K/MIL/2017 according to regulation on Criminal Law Code, Military Criminal Law Code and Law Number 31 of 1997 concerning Military Justice towards law fact which occurred on Supreme Court Decision Number 360/K/MIL/2017. The result from this study shows that the District Court judgment for granting criminal complaint on complicity in adultery crime which has exceeded the statute of limitations is not in accordance with Article 74 Act (1) Criminal Law Code. The District Code has been wrong in applying the law or groundless on law and ignoring the fact that criminal complaint has exceeded the statute of limitation, exceed 6 (six) months time period.Keywords: Statute of Limitations, Adultery
