Mülkiyet bağlamında kamu zararı kavramı: Olanaklılık ve anlam

The relations of possesion determine the separation of private/public sphere. This determination derives from the assumption of abstract person who possesses the object. Public Loss conception corresponds concrete level within the terms of motion of concrete object on one hand, while including indefiniteness in the context of public interest on the other hand. Hence, it must be treated within the separation of damage concept and public interest. As the begining of discussion of the concept of public damage and the public interest, touching on the Kant’s view of jurisprudence will be appropriate that intersects natural law aspects and forms of positive law in terms of morality. Touching the property concept in Roman law and regulations regarding to financial formalism of state in our country will also contrubute to the discussion of this purview on cencrete level.
