When employers become aware that union organizing is occurring, many unwittingly get caught committing the unfair labor practice known as the “unlawful impression of surveillance.” This does not involve actual surveillance of employees' union activities but only actions that cause employees to reasonably believe management is keeping an eye on their activities.
