Faut-il modifier l’article 66 de la Constitution qui confie a l’autorite judiciaire le soin de proteger l’individu contre les detentions arbitraires ? La question merite d’etre posee au vu des difficultes que continue a susciter le controle juridictionnel des soins psychiatriques sans consentement. Les incertitudes relatives a la repartition des competences juridictionnelles entre juge administratif et judiciaire entrainent en effet des consequences potentiellement problematiques pour la protection des patients, ce qui implique de s’interroger sur la pertinence des fondements d’un tel systeme de protection.
