Maraknya kasus perdagangan orang ( human trafficking ) di Indonesia bukan hanya menyasar pada umur dan gender tertentu, namun juga hampir semua umur baik laki-laki maupun perempuan. Bahkan beberapa kasus perdagangan orang sudah terorganisir dan menjadi kejahatan yang melintasi batas negara. Hukum pidana dan aturan hukum terkait perdagangan manusia baik secara nasional maupun internasional telah berlaku dan memiliki kekuatan hukum mengikat, namun demikian, fakta di lapangan membuktikan bahwa aturan hukum tersebut belum cukup memberikan efek jera bagi pelaku. Bahkan, aturan-aturan tersebut hanya fokus kepada pemidanaan pelaku namun mengesampingkan sisi hak-hak dan perlindungan korban. Padahal, dalam setiap kejahatan yang terjadi, selalu ada dua pihak, pelaku dan korban. Perlindungan korban dianggap penting dalam pemenuhan hak-hak asasi manusia. Tulisan ini menganalisis bagaimana perlindungan korban dalam kasus perdagangan manusia di Indonesia baik dari segi aturan hukum nasional maupun internasional. The rise of cases of human trafficking in Indonesia not only targets certain age and gender, but also almost all ages, both men and women. Even some cases of trafficking in persons have been organized and become crimes that cross national borders. Criminal law and the legal rules relating to human trafficking both nationally and internationally have been in force and have binding legal powers, however, the facts in the field prove that the rule of law is not enough to provide a deterrent effect for the perpetrators. In fact, these rules only focus on the conviction of the perpetrator but override the side of the rights and protection of the victim. In fact, in every crime that occurs, there are always two parties, the perpetrator and the victim. Protection of victims is considered important in fulfilling human rights. This paper analyzes how to protect victims in the case of trafficking in Indonesia both in terms of national and international legal rules.
