O MINISTERIO PUBLICO E A ASSEMBLEIA NACIONAL CONSTITUINTE: AS ORIGENS DE UM TEXTO INOVADOR THE PUBLIC PROSECUTOR’S OFFICE (MINISTERIO PUBLICO) AND THE NATIONAL CONSTITUENT ASSEMBLY: THE ORIGINS OF AN INNOVATIVE TEXT Mylene Comploier* RESUMO: Considerando que recentemente houve o advento da comemoracao dos 25 anos da promulgacao da Constituicao da Republica Federativa do Brasil, por alguns denominada de 'Constituicao-cidada', e que, neste periodo, o Ministerio Publico brasileiro desenvolveu uma feicao unica no espectro mundial, em muito resultado do quanto preconizado no texto constitucional, e util neste momento trazer a colacao informacoes ja disponiveis, notadamente as obtidas em entrevistas, de modo obter-se uma ideia geral de como foi a preparacao, atuacao e conquistas do Ministerio Publico na Assembleia Nacional Constituinte (ANC) e o desenho constitucional obtido, de modo a se questionar como foi possivel a aprovacao de um texto tao avancado, que superou ate mesmo as expectativas da propria classe. Ao final, conclui-se que a aprovacao deveu-se a dois fatores preponderantes, quais sejam: a organizacao da instituicao para levar um projeto de consenso ao constituinte, e o momento conjuntural historico-politico, representado pelo desejo do constituinte, em um periodo pos-ditadura, de fomentar a consolidacao de uma instituicao democratica forte em contraposicao ao regime militar. ABSTRACT: Considering that recently there was the advent of the celebration of the 25th anniversary of the promulgation of the Constitution of the Federative Republic of Brazil, by some called ‘Citizen Constitution', and that in this period the Brazilian Public Prosecutor’s Office (Ministerio Publico) has developed a unique design in the global spectrum, largely in result of what was established in the constitutional text, it is useful at this point to bring into play information already available, especially the ones gathered in interviews, in order to obtain a general idea of how was the preparation, performance and achievements of the Public Prosecutor’s Office in the National Constituent Assembly (NCA) and the constitutional design obtained, in order to question how it was possible to approve such an advanced text, which exceeded even the expectations the class itself. In the end, it is concluded that the approval was due to two major factors, namely: the organization of the institution to take one consensus project to the constituent, and the historical-political conjectural moment, represented by the constituent´s intent, in the post-dictatorship period, to promote the consolidation of a strong democratic institution in opposition to the military regime.
