Resumo: A questao da justica ambiental tem estado em pauta nas ultimas decadas no Brasil como forma de garantir uma distribuicao igualitaria dos onus e bonus da exploracao do meio ambiente. Mas como tem se dado essa garantia de justica ambiental no mundo e, especialmente, no Brasil? O problema do trabalho e, nesses termos, entender a questao da garantia de justica ambiental no ordenamento juridico brasileiro. A resposta inicial para essa proposicao e que o realismo juridico lanca o melhor enfoque sobre a tematica, uma vez que proporciona o desapego da lei e permite ao juiz fazer como for necessario para que se garanta justica de fato, proporcionando um respaldo teorico para essa posicao mais ativista do magistrado. Essa hipotese sera testada analisando alguns casos jurisprudenciais exemplificativos, em que o juiz se desvinculou da norma juridica para julgar o caso, de forma a provar se o realismo, afinal, pode promover ou nao a garantia da justica ambiental. Abstract: The matter of environmental justice has been in evidence on the last decades in Brazil as a way of assuring an egalitarian distribution of the onus and bonus of the environment exploration. But how this assurance of environmental justice has been occurring in the world and, most especially, in Brazil? The object of the present work is, in these terms, to understand the guarantee of environmental justice on the Brazilian legal order. The initial answer for this proposition is that legal realism casts a better light over the theme once it allows the detachment from law and allows the judge to make whatever is necessary to assure justice, providing a theoretical support for this more activist judge’s attitude. This hypothesis will be tested analyzing some exemplary legal cases in which the judge detached himself from the legal norm to judge the case, in order to prove if realism, after all, can promote or not the assurance of environmental justice.
