The legal protection of indigenous right, throughout the brazilian constitutions, brings an initial search to insert native peoples into the so-called national communion, imposing the abandonment of ancestral practices and assimilation of the dominant culture, reflecting the colonial bases of the State. The Brazilian Federal Constitution of 1988 puts an end to the integrationist and assimilationist ideals, protecting the alterity. The National Truth Commission unveils the actions of the State agencies that, using violence and omission, they promoted the invasion of the ancestral lands of the indigenous peoples. Analytical and descriptive work carried out through bibliographic and documentary research, focused on the legal debate that involves indigenous law stamped in brazilian constitutional texts, its jurisprudence and in the National Truth Commission report.
