ABSTRAK          Penulisan ini bertujuan untuk mengkaji kesesuaian penetapan tersangka oleh hakim Pra Peradilan dengan kewenangan Pra Peradilan. Metode penelitian yang digunakan adalah penelitian hukum normatif bersifat preskriptif. Sumber bahan hukum yang digunakan adalah bahan hukum primer dan bahan hukum sekunder, dengan teknik analisis bahan hukum menggunakan metode silogisme dan interpretasi dengan menggunakan pola berpikir deduktif.     Penulis tertarik untuk meneliti sebuah perkara mantan Wakil Presiden Boediono dengan Termohon Komisi Pemberantasan Korupsi (KPK) dan Pemohon Perkumpulan Masyarakat Anti Korupsi Indonesia (MAKI). Penetapan Tersangka oleh Hakim Pra Peradilan dinilai tidak sesuai dengan kewenangan Pra Peradilan dan dipandang telah melaksanakan yuridiksi yang melewati batas kewenangan yang dimiliki Pra Peradilan. Hakim tunggal dalam perkara Pra Peradilan Nomor 24/Pid.Pra/2018/JKT.SEL menjatuhkan putusan memerintahkan termohon untuk melakukan proses hukum selanjutnya, sesuai dengan ketentuan hukum dan peraturan perundang-undangan yang berlaku atas dugaan tindak pidana korupsi Bank Century dalam bentuk melakukan penyidikan, dan menetapkan tersangka terhadap Boediono, Muliaman D Hadad, Raden Pardede dan kawan-kawan. Sebagaimana tertuang dalam surat dakwaan atas kejaksaan untuk dilanjutkan dengan penyelidikan, penyidikan, dan penuntutan dalam proses persidangan di Pengadilan Tipikor Jakarta Pusat. Putusan itu tidak biasa karena perintah untuk menetapkan tersangka tidak termasuk kompetensi Pra Peradilan yang selama ini berlaku dan dipandang melampaui wewenang karena penetapan tersangka merupakan wewenang penyidik setelah terpenuhinya minimum alat bukti, serta perbuatan yang dilakukan dan delik yang dipersangkakan telah sesuai. Sehingga penetapan tersangka oleh Hakim Pra Peradilan tidak sah.    Kata Kunci : Penetapan Tersangka, Pra Peradilan, Bank Century          ABSTRACT    This research aims to   determine conformity of a suspect by a Pre-trial judge with Pre-trial authority. The research method used is normative legal research that is prescriptive. The sources of legal material used are primary legal materials and secondary legal materials, with legal material analysis techniques using syllogism and interpretation methods using deductive thinking patterns.     The author is interested in examining a case of former Vice President Boediono with the Respondent of the Corruption Eradication Commission (KPK) and the Indonesian Anti-Corruption Society Association (MAKI) Petitioner. Determination of the Suspect by a Pre-Judicial Judge is deemed not in accordance with the authority of the Pre-Court and is deemed to have carried out jurisdiction over the limits of authority possessed by the Pre-Court. Single Judge in the case of Pre-Court Number 24 / Pid.Pra / 2018 / JKT.SEL issues a decision ordering the respondent to conduct further legal proceedings, in accordance with the legal provisions and legislation applicable to the alleged corruption of Century Bank in the form of conducting investigations , and set the suspect against Boediono, Muliaman D Hadad, Raden Pardede and friends. As stated in the indictment of the prosecutor's office to proceed with investigation, investigation and prosecution in the trial process at the Central Jakarta Corruption Court. The decision is unusual because the order to determine a suspect is not included in the Pre-Court competency that has been valid and is considered to be beyond the authority because the determination of the suspect is the authority of the investigator after the minimum evidence has been fulfilled, as well as the act and the alleged offense is appropriate.
