O presente trabalho e um ensaio teorico que trata de analisar o conflito entre o direito fundamental a moradia e o direito fundamental ao meio ambiente. Partindo da analise da evolucao da incorporacao da tutela da moradia e do ambiente ao ordenamento juridico como direitos, analisa a presenca de ambas como direitos fundamentais na Constituicao de 1988. Partindo do pressuposto de inexistencia de hierarquia entre ambos os direitos, busca finalmente apresentar o metodo da ponderacao de valores e da concordância pratica, como forma de solucao de conflito entre direitos fundamentais. Abstract This paper is a theoretical rehearsal that analyzes the conflict between the fundamental right to housing and the fundamental right to the environment. Based on the analysis of the evolution of the incorporation of housing and protection of the environment in the law, analyzes the presence of both as fundamental rights in the 1988 Constitution. Assuming absence of hierarchy between both rights, search finally present the method and the weighting of practical agreement as a way of resolving conflict between fundamental rights.
