DOI: 10.12957/rdc.2017.26922 O aplicativo de celular conhecido como Uber se define como um intermediario entre passageiros interessados em se deslocar pelos centros urbanos e proprietarios de automoveis interessados em oferecer transporte individual remunerado. Este aplicativo, originario de Sao Francisco na California, acabou causando certa polemica em todos os paises em que atua por estar supostamente envolvido com concorrencia desleal em relacao aos servicos de taxi – os quais possuem uma serie de exigencias legais para operar que nao estao sendo exigidas na mesma proporcao dos motoristas parceiros do Uber. Este artigo se propoe a analisar a atuacao do Uber no Brasil a partir das primeiras experiencias do aplicativo no pais: Rio de Janeiro (2014), Sao Paulo (2014), Belo Horizonte (2014) e Distrito Federal (2015), bem como as implicacoes desta modalidade de servico para a mobilidade urbana. Como referencia para a discussao, serao enfatizados os posicionamentos dos Poderes Executivo, Legislativo e Judiciario em relacao aos principais pontos de discordia: i. a suposta captura regulatoria dos Poderes Legislativo e Executivo pelos taxistas; ii. a seguranca publica; iii. a protecao economica do consumidor; iv. os congestionamentos;e v. a qualidade do servico.Por fim, considera-se que tanto a livre concorrencia quanto a reserva de mercado no transporte individual de passageiros possuem a mesma finalidade: promover o acesso universal a cidade. Contudo, nao seria prudente responder qual dos dois caminhos melhor atende a sua finalidade sem estar associado a um estudo empirico sobre a real necessidade de transporte individual em cada cidade especifica. Abstract The mobile app known as Uber defines itself as an intermediary between passengers interested in moving around in urban centers and car owners interested in offering paid individual transportation. This application – originally from San Francisco, California – has caused some controversy in all countries where it operates for allegedly being involved in unfair competition over taxi services – which have a number of legal requirements to operate that are not being required in the same proportion from the drivers partners of Uber. This paper proposes to analyze Uber’s performance in Brazil from the first experiences of the application in the country: Rio de Janeiro (2014); Sao Paulo (2014); Belo Horizonte (2014); and Federal District (2015), as well as implications of this modality of service for urban mobility. As a reference for the discussion, will be considered the positions of the Executive, Legislative and Judiciary authorities in relation to the main controversial points: i. the supposed regulatory capture of the Legislative and Executive by taxi drivers; ii. the public security; iii. the economic protection of the consumer; iv. the traffic; andv. the quality of the service. Finally, it is considered that both, free market and market reserve for individual passenger transport, have the same purpose: to promote universal access to the city. However, it would not be appropriate to answer which of the two paths best serves its purpose without taking in consideration an empirical study of the real need for individual transportation in each specific city. INTERESSE PÚBLICO NO TRANSPORTE INDIVIDUAL DE PASSAGEIROS: UM ESTUDO SOBRE O CASO UBER NO BRASIL
