2001年4月の情報公開法の施行と国立公文書館法の一部改正により国の行政機関から国立公文書館への新しい公文書移管制度が始まった。しかし移管は円滑に進んでいるとは言えず現在内閣府に置かれた「公文書等の適切な管理保存及び利用に関する懇談会」の報告書の提言に基づき改革が進められている。公文書等の移管は各行政機関と内閣総理大臣の合意に基づいて行われる。国立公文書館は移管についての意見を内閣総理大臣に提出できるが意見照会しても必ずしも移管に結びつかない。諸外国の例に学びながら政府機能の把握公文書の廃棄権限現用・非現用文書の概念の見直し文書管理法等の検討が必要である。
